These Terms of Service (“Terms”) govern your use of tutruvio.com (the “Platform”), operated by VIREXAP LTD, trading as Tutruvio (“Tutruvio”, “we”, “our” or “us”). By creating an account, buying a course or selling on Tutruvio you agree to these Terms, our Privacy Policy, Payment Terms, Return and Refund Policy and Cookie Policy. If you do not agree, please do not use the Platform.
1. About us
Tutruvio is operated by VIREXAP LTD, a company registered in England and Wales under company number 17298070, registered address Unit 13 Roding House, Barking, United Kingdom, IG11 8NL. You can contact us at contact@tutruvio.com.
2. Our service
Tutruvio is an online marketplace for digital courses. Independent course creators (“Sellers”) publish courses, and learners (“Buyers”) buy and access them. Tutruvio sells digital content only; there are no physical products and no delivery.
When you buy a course, your contract for the supply of that digital content is with Tutruvio, and we are responsible for your statutory rights as a consumer. The course content itself is created by the Seller, who is responsible for its accuracy and for holding the rights to it.
3. Eligibility
You must be at least 18 years old to create an account, buy or sell on Tutruvio. By using the Platform you confirm that you are 18 or over, that the information you give us is accurate, and that you are not prohibited from using our services under applicable law, including sanctions laws. We do not offer our services in certain countries; the countries available are shown at checkout.
4. Your account
You are responsible for keeping your login details confidential and for all activity on your account. Tell us immediately at contact@tutruvio.com if you suspect unauthorised use. You can delete your account at any time in Account → Settings.
5. Buying courses
5.1 Prices and payment
Prices are shown in euros (EUR) and include VAT where applicable. Prices shown in other currencies through the currency selector are for information; the amount and currency you will be charged are shown at checkout before you pay. We accept Visa and Mastercard cards only, as described in our Payment Terms.
5.2 Order confirmation and invoice
Your order is accepted when your payment is authorised. We then email you an order confirmation with your invoice attached as a PDF. Your invoices are also available at any time in Account → Orders.
5.3 Access to courses
Purchased courses are available immediately after payment in Account → Orders and Account → Downloads. Unless the course page says otherwise, you have lifetime access for as long as the Platform operates. If a course becomes permanently unavailable, our Return and Refund Policy applies.
5.4 Cancellation and refunds
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have 14 days to cancel a contract for digital content. Because courses are supplied immediately, at checkout we ask you to agree that supply begins straight away and to acknowledge that your statutory cancellation right ends once you start accessing the course.
In addition, we offer a voluntary 14-day refund guarantee: you can request a refund within 14 days of purchase provided you have accessed less than 25% of the course and have not downloaded it in full. Your rights under the Consumer Rights Act 2015 for digital content that is faulty or not as described are not affected. Full details are in our Return and Refund Policy.
5.5 Licence to use courses
When you buy a course you receive a personal, non-exclusive, non-transferable licence to view and download it for your own non-commercial learning. You may not copy, share, resell, publicly display or distribute the content, or share your account with others.
6. Selling on Tutruvio
6.1 Becoming a Seller
To sell on Tutruvio you must be 18 or over, own or have the right to license the content you publish, and comply with all laws that apply to you, including tax laws.
6.2 Course review
Every new or edited course is reviewed by our team before it is published. We will email you when a course is submitted, approved or rejected; if we reject a course we will tell you why. Courses must be accurate, original, lawful and clearly described, and must not contain misleading, offensive or infringing material. We may remove or suspend courses that breach these Terms.
6.3 Earnings and commission
For each sale, the Seller’s earnings are the course price less Tutruvio’s commission. The applicable commission is shown in the Seller dashboard before you publish a course.
6.4 Balance, holding period and payouts
- Earnings from a sale are shown as on hold for 14 days after the order is completed, to cover the Buyer’s refund period.
- After the holding period the earnings become available and can be withdrawn.
- You can request a payout of your available balance from Account → Payouts to a bank account or a debit card in your own name. The minimum payout is €20.
- Before your first payout you must complete identity verification (KYC) in Account → Verification. We review submissions within 3 business days.
- Approved payout requests are processed within 5 business days. Your dashboard shows your on-hold, available and paid-out amounts and the history of your payouts.
- If a sale is refunded or charged back, the amount is deducted from your balance or from future earnings.
- You are responsible for declaring and paying any tax on your earnings.
6.5 Licence you grant us
Sellers keep ownership of their content and grant Tutruvio a non-exclusive, worldwide licence to host, display, market and distribute it to Buyers through the Platform for as long as it is listed, and afterwards to Buyers who have already purchased it.
7. Platform rules
You must not:
- use the Platform for any unlawful, fraudulent or harmful purpose;
- infringe anyone’s intellectual property or privacy;
- post or send abusive, hateful, discriminatory or misleading content;
- attempt to take payments outside the Platform or to get around our payment, access or security systems;
- interfere with the operation of the Platform, for example with automated scraping or malicious code.
8. Messages
Buyers and Sellers can message each other about courses and orders. Messages must be respectful and relevant, and must not contain spam, personal attacks or requests to pay outside the Platform. We may moderate messages and remove content that breaches these Terms.
9. Suspension and termination
We may suspend or close an account that breaches these Terms, is used fraudulently or where we are required to by law. Where possible we will tell you why. If we close your account without fault on your part, you keep access to courses you have already bought, or receive a refund for any you can no longer access.
10. Our liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law, including your statutory rights as a consumer.
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. If digital content we supply damages a device or other digital content belonging to you, we will either repair the damage or pay you compensation.
If you use the Platform as a Seller or otherwise for business purposes, our total liability to you is limited to the commission we earned from your sales in the 12 months before the claim arose, and we are not liable for loss of profit, revenue or business opportunity.
11. Complaints and disputes
If you have a complaint, please email contact@tutruvio.com. We aim to respond within 5 business days. Disputes between Buyers and Sellers about an order are first handled by our support team.
12. Governing law and jurisdiction
These Terms are governed by the law of England and Wales. Disputes may be brought in the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
13. Changes to these Terms
We may update these Terms to reflect changes in the law or in our services. The current version is always published on this page with its effective date. We will notify registered users of material changes by email at least 14 days before they take effect. Orders already placed are governed by the Terms in force when the order was made.
